I guess he is entitled to due process. Even Blogojevich is innocent until proven guilty.
Also, from what I read, he denied any involvement and it is based on the girl recognizing him which is always somewhat suspect. I assume more evidence was presented at the hearing.

Then again, Texas sent a guy to death just based upon the testimony of an eyewitness in a car at dusk 20 feet from the crime who picked him out of a book of felons.
